Giveaways are run by Card Kraken and are not sponsored, endorsed, or administered by Facebook or by The Pokémon Company. Entry requirements and winners are posted with each giveaway; winners are drawn at random from valid public entries. Void where prohibited.
Card images and names are property of their respective owners and are shown for identification and commentary. Prices and “guess the price” figures are estimates for entertainment, not financial advice.
What we sell. We sell single trading cards and sealed or repackaged lots that we own and have on hand. Each listing describes one specific card or lot, and the photographs on a listing are of the item you receive unless the listing says otherwise.
Your order is an offer. Placing an order is an offer to buy, which we accept when we ship it — not when the page says thank you and not when your payment is authorised. Until we ship, we may cancel any order and refund you in full. That is not a formality: the same card is usually listed both here and on eBay, so one can sell twice within the same minute. We may also cancel if a card turns out not to match its description, or if a price was published in error. A full refund is the entire remedy for a cancelled order.
Payment. Payment is taken at checkout through Stripe or PayPal, or from your Card Kraken store credit. We never see or store your full card number. The price shown on a listing is the price charged — postage is already inside it and no separate shipping line is added. Where an order is paid with store credit and is later refunded, the credit returns to your balance rather than to a card.
Title and risk. Ownership and risk of loss pass to you on delivery. If a package is lost or damaged in transit, that is ours to sort out — tell us.
Age. You must be 18 or older to buy from us.
Three separate pages carry the detail, and they are part of these terms: how we grade condition, how and when orders ship, and what happens when something is not as described. Where those pages and this one differ about an order, those pages govern.
Our pages, prices, estimates and availability are provided “as is” and “as available.” To the fullest extent allowed by law we disclaim the implied warranties of merchantability, fitness for a particular purpose, and accuracy. Prices and identifications are produced by software, best-effort, and can be wrong.
Nothing in that paragraph limits our returns policy. If a card arrives significantly not as described, the remedy on our returns page applies in full, and the disclaimer above does not cut it down. Nor does anything here exclude liability that cannot lawfully be excluded.
To the fullest extent allowed by law, Card Kraken is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost sales, arising out of these pages, our posts, a giveaway, or a purchase. Our total liability to you for all claims relating to an order is limited to the greater of (a) $100, or (b) the amount you paid for that order.
Talk to us first. Before filing any claim, please contact us and allow 30 days to resolve it informally. Most problems with an order are a returns question, and those are settled fastest by message.
No arbitration. There is no arbitration requirement and no class-action waiver in these terms. Either of us may still bring a qualifying claim in small-claims court.
Governing law. These terms are governed by the law of West Virginia, without regard to its conflict-of-laws rules.
Venue. Any claim not resolved informally, and not brought in small-claims court, must be brought in the state or federal courts located in Fayette County, West Virginia — the venue that follows from the governing law above. This does not deprive you of the protection of any mandatory consumer law of the state where you live.
We may update this page. The terms that govern an order are the ones published when you placed it, so a later change cannot rewrite a sale that already happened.
